Students who have been accused of sexual misconduct under Title IX face a number of different challenges.  They could be exposed to punishments that include academic suspension, expulsion, and more.  Depending on the outcome of the Title IX proceeding, the student’s career and social life could be upturned entirely, creating significant roadblocks to a return to normalcy.

Given the high-stakes nature of Title IX proceedings, accused students are best served by contacting a qualified attorney for guidance.

Attorneys and Hearings in a Title IX Proceeding

Institutional norms vary with respect to Title IX proceedings.  As schools are not required to give accused students the right to attorney representation at a Title IX hearing, many choose not to grant the privilege.

If your school does not allow for attorney representation at a Title IX hearing, that can put you at a disadvantage — but it is not entirely unexpected.  Further, you can (and should) still hire an attorney to represent you during the overall proceeding.

How an Attorney Can Help

Even if your attorney is unable to represent you at a hearing, they will be able to assist you in many other ways.  For example, your Title IX defense attorney can investigate the facts on your behalf (i.e., working with witnesses, experts, etc.) and also provide guidance as you go through each step of the Title IX proceeding.

If school investigators begin to question you aggressively about various aspects of the underlying matter, you’ll be prepared — a skilled attorney will have worked with you to ensure that you understand what information you should and should not disclose.  This is crucial to avoid incriminating yourself and undermining your arguments.

Further, your attorney will work to make sure that the administration is enforcing their own procedures “honestly.”  If the school grants certain legal and procedural protections but does not enforce them, then your attorney will be able to identify the violation and compel the school to adhere to those rules.
