Perjury

Perjury is the intentional act of swearing a false oath or of falsifying an affirmation to tell the truth concerning matters material to an official proceeding. Perjury is a violation of federal and state law that can subject the person committing perjury to fines and prison time.

While people often draw inaccurate misconceptions of fact, this is not considered perjury. Declarants are entitled to have false yet honest misconceptions of fact. Perjury is where the declarant has the intention to commit the act, actually commit the act, and the information must be material to the proceedings.
